Acceptance of the Terms

Welcome to LinkPop! These terms and conditions are entered into by and between you and Mirage AI LLC ("Company," "we," or "us"). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, "Terms"), govern your access to and use of our website (https://linkpop.to/), including any content, functionality and services offered on or through our website (collectively, the "Platform").

Please read these Terms carefully before you start to use the Platform. By using the Platform, you accept and agree to be bound and abide by these Terms. If you do not want to agree to these Terms, you must not access or use the Platform.

Changes to the Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes.

Changes to Platform

We reserve the right to withdraw or change the Platform, including any content, functionality, and services, in our sole discretion, without notice. We will not be liable if for any reason all or any part of the Platform is unavailable at any time or for any period.

Accessing the Platform and Account Security

To access the Platform, you may be asked to provide certain registration details or other information to create an account. When you create an account, you agree to comply with these Terms and that you're over 18 and legally able to enter these Terms with us. If you're using the Platform on behalf of a business, you confirm that you're authorized to agree to these Terms on its behalf.

Creating multiple accounts is strictly prohibited on the Platform. We have a strict one-account-per-user policy. If you are found to be operating multiple accounts, you will face immediate account suspension or permanent banning.

You must treat your password as confidential, and you must not disclose it to any other person or entity. You agree to notify us immediately of any unauthorized access to or use of your username or password or any other breach of security.

User Content

All text, graphics, photos, videos, links and any other materials you submit or contribute to the Platform ("User Content") will be considered non-confidential and non-proprietary. By submitting or contributing any User Content on the Platform, you grant us an irrevocable, perpetual, royalty-free, worldwide, sublicensable, transferable right to: (a) use, publicly display, distribute, modify, adapt and create derivative works of such User Content; and (b) use your name, image, voice, photograph, likeness and any other personal attributes in the content on the Platform and in our marketing in all media (such as our social channels and any other advertising).

You represent, warrant and covenant that: (i) you own or control all rights in and to the User Content and have the right to grant the license granted above; and (ii) all of your User Content does and will comply with these Terms.

You understand and acknowledge that you are responsible for any User Content you submit or contribute, and you, not the Company, have full responsibility for such content, including its legality, reliability, accuracy, and appropriateness.

We are not responsible or liable to any third party for the content or accuracy of any User Content posted by you or any other user of the Platform.

Content Standards

These content standards apply to any and all User Content. User Content must in its entirety comply with all applicable federal, state, local, and international laws and regulations. Without limiting the foregoing, User Content must not:

• Contain any material that is vulgar, defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
• Promote pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
• Infringe any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person.
• Violate the legal rights (including the rights of publicity and privacy) of others.
• Be likely to deceive any person.
• Promote any illegal activity.
• Cause annoyance, inconvenience, or needless anxiety or be likely to upset, embarrass, alarm, or annoy any other person.
• Impersonate any person or misrepresent your identity.
• Involve commercial activities or sales without our consent.
• Give the impression that they emanate from or are endorsed by us without permission.

Company Intellectual Property

The Platform, including its contents, features, and functionality, is owned by the Company, its licensors, or other providers of such material and is protected by United States and international laws.

You do not acquire any rights in our brand name or logo and may not use them without prior written approval.

You are granted a limited, revocable, non-exclusive, and non-transferable right to use the Platform in accordance with these Terms.

Prohibited Uses

You may use the Platform only for lawful purposes. You agree not to:

• Violate any laws.
• Exploit or harm minors.
• Send or upload any material that violates these Terms.
• Send spam or unsolicited content.
• Impersonate others.
• Interfere with the Platform's functionality.
• Access, scrape, or use data from the Platform without permission.
• Introduce malware or other harmful code.
• Attempt to gain unauthorized access.
• Reverse engineer or tamper with the Platform.

Privacy Policy

By using the Platform, you agree to our Privacy Policy at https://linkpop.to/privacy, which is incorporated by reference.

All data generated from your use of the Platform is owned by us.

Monitoring and Enforcement; Termination

We reserve the right to:

• Remove or refuse User Content.
• Disclose your identity to third parties for rights violations.
• Take legal action against unauthorized uses.
• Terminate or suspend your account.

We cooperate with law enforcement and reserve the right to remove content or terminate accounts without notice.

Fees and Payment

You may use LinkPop under a free or paid plan. Paid plans auto-renew unless canceled. You can cancel at any time via your dashboard or Telegram at https://t.me/linkpop_support. Refunds are only offered within the first 14 days of a paid plan by emailing contact@linkpop.to or messaging us on Telegram.

Subscription fees are in USD and include applicable taxes. We may update our fees with prior notice. Paddle.com is our Merchant of Record and handles payments and customer service.

Reliance on Information Posted

We make no guarantees regarding the accuracy or usefulness of information on the Platform. Any reliance is at your own risk. Content provided by third parties does not reflect our views, and we are not responsible for it.

Links from the Platform

The Platform may contain links to third-party sites. We do not control or endorse them and are not responsible for any resulting loss or damage.

Confidentiality

If we share confidential information (e.g., during beta testing), you agree to keep it secure and not disclose it to others.

Linking to the Platform and Social Media Features

You may link to our Platform fairly and legally. Do not imply affiliation or endorsement. Social media features must be used as provided. We may withdraw linking permissions at any time.

Feedback

Any feedback you provide is voluntary and may be used by us without compensation or restriction.

Disclaimer of Warranties

We do not guarantee the Platform is secure, error-free, or uninterrupted. Use is at your own risk. We disclaim all warranties to the extent permitted by law.

Limitation on Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, consequential, or punitive damages. Our total liability to you will not exceed $100 or the amount you paid us in the previous 12 months.

Indemnification

You agree to indemnify and hold harmless the Company and its affiliates from any claims or damages arising from your use of the Platform or violation of these Terms.

Governing Law and Jurisdiction

These Terms and all matters relating to the Platform are governed by the laws of the State of Delaware.
